Welcome to MyBranches ("we," "us," "our," or "MyBranches"). These Terms and Conditions ("Terms") govern your access to and use of our website (mybranches.ai), services, and products. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. About Our Services

MyBranches provides a platform and services to create personalized, AI-generated children's books based on family members' life stories, photos, and memories. Our mission is to preserve family legacies and strengthen generational connections while supporting children in foster care through our donation program.

Our Services Include:

• Web-based platform for ordering personalized family books

• AI-powered content creation (stories and illustrations)

• Digital book delivery (eBook format)

• Physical printed book production and shipping

• Interview services to capture family stories

• Customer support and order management

2. Eligibility and Account Creation

Age Requirements

You must be at least 18 years old to use our services and place orders. By using MyBranches, you represent and warrant that you are of legal age to form a binding contract.

Account Registration

• You may need to create an account to access certain features

• You are responsible for maintaining the confidentiality of your account credentials

• You agree to provide accurate, current, and complete information

• You must notify us immediately of any unauthorized use of your account

• We reserve the right to suspend or terminate accounts that violate these Terms

Parental Consent

When you provide information about children (names, birthdates, photos) for book personalization, you represent that you are the parent or legal guardian of those children, or have obtained proper consent from their parent/guardian.

3. Orders and Payments

Pricing

Our current pricing structure is:

• Digital Book Only: $19

• Digital + Printed Book Bundle: $50

• Digital Book with Later Print Add-On: $20 initially, then $40 for printed book

• Additional Printed Copies: $40 per copy (for reorders)

• Foster Child Donation Books: $10 per additional donated book (optional)

All prices are in U.S. dollars and are subject to change without notice, though any changes will not affect orders already placed.

No Discounts Policy

MyBranches does not offer discounts, promotional codes, or sales on our products. The only exception is our free shipping offer on orders of 2+ printed books shipped to the same address.

Payment Processing

• Payment is required at the time of order

• We accept major credit cards, debit cards, and other payment methods as displayed at checkout

• Payment processing is handled by secure third-party providers (e.g., Stripe, PayPal)

• By providing payment information, you authorize us to charge your payment method for all fees incurred

Taxes

You are responsible for any applicable sales tax, VAT, or other taxes based on your location. Taxes will be calculated and added at checkout where required.

Order Confirmation

Once your order is placed, you will receive an email confirmation with order details. This confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

• Product availability

• Errors in pricing or product information

• Suspected fraudulent activity

• Violation of these Terms

If your order is cancelled, we will refund any payment received.

4. Product Creation Process

Customer Responsibilities

When ordering a personalized book, you agree to:

• Provide accurate information about the child and featured family member

• Respond promptly to requests for additional information or clarification

• Participate in or facilitate the interview process (via AI chat, phone, or form)

• Provide clear, high-quality photos of the featured family member

• Review the digital preview carefully before approving printing

Content Guidelines

All content you provide must:

• Be truthful and accurate to the best of your knowledge

• Not infringe on third-party intellectual property rights

• Not contain illegal, offensive, defamatory, or inappropriate material

• Comply with our content standards (no hate speech, violence, explicit content, etc.)

We reserve the right to refuse or modify content that violates these guidelines.

Interview Process

• We offer multiple interview methods: AI chat, phone interview, or online form

• Interviews typically take 20-45 minutes

• The featured family member (or their representative) must consent to the interview

• We may record interviews for quality and accuracy purposes

• Interview responses become part of your personalized book content

AI-Generated Content

Our books are created using artificial intelligence technology for both story writing and illustration:

• AI interprets the information provided to create unique, personalized content

• Illustrations are generated based on photos you provide

• While we strive for accuracy and quality, AI-generated content may require human review and editing

• You will have the opportunity to review and request edits during the preview stage

Preview and Approval

• You will receive a digital preview of your book within approximately 2 weeks of completing the interview

• You have 7 days to review the preview and request edits

• Minor edits (typos, factual corrections, illustration adjustments) are included

• Major rewrites or substantial changes may incur additional fees

• Once you approve the preview, the book proceeds to printing (if ordered)

• After approval, no further changes can be made to printed books

Production Timeline

• Digital preview: Approximately 2 weeks after interview completion

• Printing and shipping: 5-10 business days after approval (domestic U.S.)

• International orders may take 2-4 weeks

• Custom or bulk orders may have extended timelines

• Timelines are estimates and may vary due to volume, complexity, or unforeseen circumstances

5. Shipping and Delivery

Shipping Policy

• Free Shipping: Orders of 2+ printed books to the same address receive free standard shipping

• Standard Shipping: Charged at checkout for single book orders

• Shipping Destinations: We currently ship within the United States; international shipping may be available at checkout

• Delivery Times: 5-10 business days for domestic orders after printing is complete

• Tracking: You will receive tracking information via email once your order ships

Shipping Address

• You are responsible for providing accurate shipping addresses

• We are not responsible for delays or non-delivery due to incorrect addresses

• Address changes must be requested before shipment; contact us immediately if needed

​

Risk of Loss

Risk of loss and title for printed books pass to you upon delivery to the shipping carrier.

Delivery Issues

If your book is lost, damaged, or not delivered:

• Contact us within 30 days of the estimated delivery date

• Provide order details and, if applicable, photos of damage

• We will work with you to resolve the issue (replacement, refund, or credit)

6. Digital Books

Access and Delivery

• Digital books (eBooks) are delivered via email as a downloadable PDF file

• You will receive your eBook within 1-2 business days after approval

• Digital files are for personal use only

​

Technical Requirements

• Digital books require a device capable of viewing PDF files (computer, tablet, smartphone, e-reader)

• We are not responsible for compatibility issues with your device

• If you have trouble accessing your eBook, contact us for support

​

Backup and Storage

• You are responsible for downloading and storing your digital book

• We recommend saving a backup copy

• We retain digital files for 90 days after delivery; after that, re-delivery may incur a fee

​

7. Intellectual Property Rights

Your Content

• You retain all rights to the content you provide (stories, photos, personal information)

• By submitting content, you grant us a limited, non-exclusive license to use it solely for creating your personalized book

• This license includes the right to reproduce, adapt, and display your content as necessary to provide our services

• We will not use your content for any other purpose without your consent

Our Content

• MyBranches owns all rights to our website, platform, technology, AI models, designs, templates, and branding

• Our AI-generated illustrations and formatted book layouts are protected by copyright

• You may not copy, reproduce, distribute, or create derivative works from our proprietary content

Your Finished Book

• You receive a personal, non-commercial license to your finished book

• You may print additional copies for personal use through our reorder service

• You may not reproduce, sell, or distribute your book commercially without our written permission

• You may share your book privately with family and friends

​

Trademarks

MyBranches, our logo, and related marks are trademarks of MyBranches. You may not use our trademarks without prior written consent.

8. Refund and Cancellation Policy

Digital Books

• Due to the personalized nature of our products, digital books are generally non-refundable once delivered

• If there is a significant error or defect in the digital book that we cannot correct, we will provide a full refund

• Refund requests must be made within 7 days of digital book delivery

Printed Books

• Printed books are non-refundable once printing has begun

• If you cancel your order before we begin printing, we will provide a full refund minus any processing fees

• If your printed book arrives damaged or defective, contact us within 30 days for a replacement or refund

• Refunds for defective books will be issued after we receive photo evidence or the returned book

​

Order Cancellation

You may cancel your order at any time before the digital preview is delivered by contacting us at info@mybranches.ai. Cancellations after preview delivery but before printing approval will result in a partial refund (you retain the digital book, minus its $19 value from your refund).

Our Right to Cancel

We reserve the right to cancel orders that:

• Violate our content guidelines

• Contain fraudulent information

• Are suspected of being fraudulent or illegal

• Cannot be fulfilled due to technical or operational issues

In such cases, we will provide a full refund.

9. Foster Child Donation Program

How It Works

• For every book purchased, MyBranches donates one book to a child in foster care

• Customers may contribute an additional $10+ per book to sponsor more donations

• Donation books are pre-designed with uplifting, resilience-focused stories (not personalized to individual foster children)

• We partner with foster care organizations to distribute donated books

No Tax Deduction

• MyBranches handles all donations directly

• Customer payments for our products are not tax-deductible charitable contributions

• Optional donation add-ons are considered part of your purchase and are also not separately tax-deductible

Our Commitment

We are committed to transparency in our donation program. While we strive to donate books as stated, our ability to fulfill donations depends on operational capacity, partnerships, and resources. We will make reasonable efforts to honor our commitment.

10. User Conduct and Prohibited Uses

You agree not to:

• Use our services for any unlawful purpose or in violation of these Terms

• Provide false, inaccurate, or misleading information

• Impersonate any person or entity

• Upload content that infringes on intellectual property rights, contains malware, or is harmful

• Attempt to hack, disrupt, or damage our website or services

• Use automated tools (bots, scrapers) to access our services without permission

• Resell or commercialize our products without authorization

• Harass, abuse, or harm our staff, contractors, or other users

Violation of these rules may result in immediate termination of your account and legal action.

11. Privacy and Data Protection

Third-Party Integrations

Our services rely on various third-party tools and services, including but not limited to:

• AI content generation tools (e.g., Grok, Nano Banana, Midjourney)

• Communication platforms (e.g., ElevenLabs, Twilio)

• CRM and automation tools (e.g., Folk, Zapier, N8N)

We are not responsible for the performance, policies, or practices of these third parties. Your use of third-party services is subject to their terms and policies.

13. Disclaimers and Limitations of Liability

Service "As Is"

• Warranties of merchantability, fitness for a particular purpose, or non-infringement

• Guarantees of uninterrupted, error-free, or secure service

• Accuracy, reliability, or quality of AI-generated content

AI Content Disclaimer

While we use advanced AI technology, we do not guarantee:

• Perfect accuracy in story generation or factual representation

• That AI-generated illustrations will exactly match the subject's appearance

• That all content will meet your subjective preferences or expectations

You have the opportunity to review and request edits before final approval.

Limitation of Liability

To the fullest extent permitted by law, MyBranches and its owners, employees, contractors, and partners shall not be liable for:

• Indirect, incidental, consequential, or punitive damages

• Loss of profits, data, or goodwill

• Service interruptions, errors, or delays

• Damages arising from your use or inability to use our services

• Damages arising from third-party services or content

Our total liability to you for any claim arising from these Terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Exceptions

Some jurisdictions do not allow limitations on implied warranties or exclusions of certain damages. In such cases, the above limitations may not apply to you, and our liability will be limited to the maximum extent permitted by law.

• Your use of our services

• Your violation of these Terms

• Your violation of any third-party rights, including intellectual property or privacy rights

• Content you provide that is inaccurate, unlawful, or infringes on others' rights

15. Dispute Resolution and Governing Law

Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Larimer County, Colorado, and you consent to the jurisdiction of such courts.

Informal Resolution

Before filing any legal claim, you agree to contact us at info@mybranches.ai to attempt to resolve the dispute informally. We will work in good faith to reach a resolution within 30 days.

Binding Arbitration (Optional)

If we cannot resolve a dispute informally, either party may elect to resolve it through binding arbitration rather than court litigation. Arbitration will be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA) in Colorado. The arbitrator's decision will be final and binding. You and MyBranches waive the right to a jury trial or to participate in a class action.

Exceptions to Arbitration: Small claims court actions (under $10,000) and claims for injunctive relief may be brought in court.

Class Action Waiver

You agree to resolve disputes with MyBranches on an individual basis only. You waive the right to bring or participate in any class action, consolidated action, or representative proceeding.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. We will notify you of material changes by:

• Email to the address associated with your account

• A notice on our website homepage or at login

Your continued use of our services after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using our services.

By You

By Us

We may suspend or terminate your access to our services at any time, with or without notice, for:

• Violation of these Terms

• Fraudulent, abusive, or illegal activity

• Non-payment

• Any reason at our sole discretion

Upon termination:

• We may delete your account and content (subject to legal retention requirements)

• Outstanding payment obligations remain due

• Provisions that by their nature should survive (e.g., intellectual property, disclaimers, indemnification) will continue to apply

18. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and MyBranches regarding our services and supersede all prior agreements or understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms to any successor or affiliate without restriction.

Force Majeure

We are not liable for delays or failures in performance due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or technical failures.
